For purposes of these "terms", and except to the extent expressly excluded below, the "company" and/or "ALC" shall mean (Ardent Lifecare), the “Site” shall mean (www.ardentlifecare.com) and any other site, web pages, mobile applications and mobile websites operated by (www.ardentlifecare.com”) and/or (Ardent Lifecare).  “Services” shall mean any of the various services that (Ardent Lifecare, ALC or www.ardentlifecare.com) provides through the Site or any other channels, including without limitation, over the telephone. Additionally, "communities" or "community" shall mean the independent entities that provide any type of senior care living communities or facilities including but not limited to independent living facilities or homes, assisted living facilities, memory care facilities, skilled nursing facilities and adult family homes.

However, the terms "websites" “site” and “Services” do not include or involve the following:

Third-party entities such as links to other websites, senior care centers, referral  agencies, in-home care agencies, and other providers that may use the Site or Services. 

 

Additionally, to use the Sites and/or Services, you must be of legal age to enter into a binding contract and not be prohibited from using the Sites and/or Services by the laws of the jurisdiction from which you access the Sites and/or Services.

 

Please read these "terms" and any applicable "additional terms" before using the Site or the Services. By using this site (www.ardentlifecare.com) including all of its site pages or the services, you hereby represent, warrant, understand, agree to and accept these "terms" and any applicable "additional terms" (if any) in their entirety whether or not you register as a user of the Site or Services.

These Terms are subject to change at any time without notification. You should periodically check this term of use page for updates. Any use of the Site or the Services by you will constitute your acceptance of such changes. These Terms supersede all prior versions of the Terms.

OUR SERVICES

"ALC" is a senior housing and senior care marketing and information service that provides resources and personalized assistance in finding senior housing and/or care. We help individuals find options based on their specific needs and preferences and permit them to make informed decisions. This may include but is not limited to, independent living, home care, residential care homes, assisted living, specialized memory care, and skilled nursing facilities. Based on the family’s stated needs and preferences, we provide the family with resourceful information about communities and we forward the family’s information to those communities. Families can review detailed information about local communities, and get personalized, knowledgeable assistance by and not limited to electronic mail, computer generated messages or telephone from an "ALC" team members. The service is offered at no charge to families as the communities pay a fee to ALC.

 

SENIOR HOUSING AND/OR CARE COMMUNITIES

The Communities are solely responsible for evaluating, accepting (or declining, as appropriate), and caring for all residents, including, without limitation, ensuring that their staff are appropriately qualified, current on education, and possess the necessary facilities, resources, and equipment to competently provide the services and care required by its residents. Each community is responsible for the conditions at its community and the training of and acts and omissions of its employees, contractors, vendors, and any other individual who works at or for a community. ALC is exclusively a referral service.

 

Each community is responsible for the content of the information posted on their websites. The information does not represent ALC views or any individual associated with our company, and we do not control this content. We do not vouch for the accuracy or completeness of any of the information posted by and/or for other communities, and do not take any responsibility or assume any liability for any actions you may take as a result of reading the information posted by and/or for communities on the Sites. By using the Sites and/or Services, you assume all associated risks. It is the decision of the individual user of to perform due diligence. We DO NOT give legal, financial, medical advice.

MATERIALS OF INFORMATION & DISCLAIMER

All information, materials, content and/or advice on the Site or provided through the Services is for informational purposes only and is not intended to replace or substitute for any professional, financial, medical, legal, or other advice. ALC expressly disclaims, and you expressly release ALC from, any and all liability concerning any treatment, action by, or effect on any person following the information offered or provided within or through the Site and/or Services. We DO NOT give medical, legal, financial or any other professional advice.

SERVICE OF PROVIDNG INFORMATION

We exercise no independent judgment as to the quality of, nor do we recommend or endorse in any method, any communities. We are a provider of information services and do not (a) place the consumer in any community, (b) perform any medical assessment of or for the consumer or the communities, or (c) participate in the consumer’s and communities decision regarding final selection or admittance. Further, we are not a representative of, or agent to the consumer or the communities and do not act on either’s behalf. It is the sole responsibility of the communities and the resident and/or the resident’s family and/or resident's family and/or Power Of Attorney (POA),  and care provider(s) and/or other involved parties acting on the potential resident’s behalf to determine if any person is an appropriate admission to the communities. ALC is not a broker service, we do not sell, or lease space directly and is not a party or involved in any transaction between the provider and the family and or resident, or potential resident.

PRIVACY AND CONSENT TO COMMUNICATIONS

Your privacy is important. By filling out any forms on the Site or providing information to us, you consent to being contacted by us and/or the communities that we do referrals with, whether by phone, mobile phone, email, mail, or otherwise. If you are a customer or potential customer of the Services, you authorize us to provide the information that you provided us and related information we may receive from third parties to communities for the purpose of providing Services. If you hereby DO NOT understand or agree with these terms, immediately cease the use of this site and it's services.

REVISIONS AND ERRATA

The materials appearing on ALC site may include technical, clerical error, typographical, or photographic errors. ALC does not warrant that any of the materials on its site are accurate, complete, or current. ALC may make changes to the materials contained on the site at any time without notice. ALC does not, however, make any commitment to update the materials.

SITE TERMS OF USE MODIFICATIONS

ALC may revise these Terms of Use for its site at any time without notice. By using this site you are agreeing to be bound by the then current version of these Terms of Use.

• In the list below are of some the actions and activities that are prohibited and not allowed by you in accessing and/or using the Site and/or Service.

• Any activity or conduct that is deemed illegal while using the Site or Service.

• Any activity that disrupts in any way with the optimal functioning of the Site. 

• Using the Sites and/or services to stalk, harass, or harm another individual.

• Engaging in any other action in any way that is unlawful or harms ALC.

• Using the Sites and/or Services to generate unsolicited email advertisements or spam; and/or allowing, enabling, or supporting the transmission of mass unsolicited, commercial advertising or solicitations via e-mail.

• Obtaining lists of users or other information, from the site or use internet “robots/bots/bot” or any data gathering or extraction methods for such purposes.

• Uploading or attempting to upload a virus, hacking, or malicious act, instruction, or design that would cause malfunction to the Site, ALC computers and/or communication systems.

• Uploading, distributing or printing anything that may be harmful to minors.

• Copy, distribute, resell, transmit, display, perform, reproduce, publish in any form, the contents of this site on any other site.

ALC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by ALC site. Use of any such linked website is at the user's own risk.

The ALC site may provide links to external Web sites (“External Web Sites”). We provide these links to External Web Sites for your convenience only. We do not control of External Web Sites; ALC is not responsible for the content of any linked site. Our inclusion of links to such External Web Sites does not imply any endorsement of any such third party who advertises their goods or services through the site. We make no claim or representation regarding, and accept no responsibility for, the quality, content, nature, or reliability of External Web Sites. External Web Sites are at your own risk. If you believe that materials displayed on ALC site infringe your copyright, you can send mail notice that includes proof of information, full description of the matter in question, ownership proof of copyright material, phone number that accepts voice calls, mailing address, business name (if applicable), state where business is registered (if applicable). In order to process your notice all information must be complete. Any false statements and/or misrepresentations of copyright material in question may expose you to liability for damages.

We may terminate or suspend your access to the site at any time, with or without cause, and with or without notice. Upon such termination or suspension, your right to use the site will immediately cease.
